(Who can file a claim on a non-arrival shipment?)
Q.
When a shipment is completely missing and do not arrive, who has the right to claim? (1 Dec 03)
A.
The person who has the right to file a claim is either the shipper, the consignee, whoever inherited the right to claim by virtue of inheritance, and insurance companies who have secured the right to claim through subrogation. In case of a consolidated shipment moving under the Guadalajara Convention or the Montreal Convention of 1999, the house shipper and house consignee both possess the right to claim either to the consolidator or to the airline or to both.
