Tunisia had ratified Warsaw, Hague and Guadalajara conventions. Japan had ratified the Warsaw, Hague, MP4 and MC99 conventions. Japan had not ratified the Guadalajara Convention. Which convention would govern air cargo traffic between Tunisia and Japan? (31 Jul 10)
A.
Since Japan had not ratified the Guadalajara Convention, the only common document that both Japan and Tunisia have ratified is the Warsaw Convention as amended by The Hague Protocol.

It is true that MC99 contains the paragraphs of the Guadalajara Convention but the conditions are based on an ?gabsolute liability?h whereas the original Guadalajara Convention ratified by Tunisia is based on an ?gassumed liability?h language, and consequently the languages are not in common. Even if Tunisia is party to the original Guadalajara Convention, Japan is not a party to it. And, since Tunisia is not party to MC99 which Japan has ratified, the only common document between Japan and Tunisia is the Warsaw Convention as amended by The Hague Protocol. ?@
