(A question on UN 3256 shipped below 140 degrees F (or 60℃))

The shipper has a shipment of Fuel Oil and has presented a MSDS which says in Section 14 that the Fuel Oil is classified as UN 3256 Elevated temperature liquid, flammable, n.o.s. ★ but if the shipment is shipped at a temperature below 60℃ it is not regulated. The shipper says the shipment is not in elevated state but in cold state below 60℃ and therefore can be shipped as not regulated. Is he correct?  (30 Nov 18)

Yes, if UN3256 is below 60℃, it is not regulated, however the shipment must be maintained at below 60℃ throughout the entire trip to destination.
