(Please explain the definition of a passenger aircraft and a cargo aircraft.)
Q.
Please clarify the definition of a “cargo aircraft” stated in the Dangerous Goods Regulations. Is the term “cargo aircraft” mentioned in DGR 9.3.4 Loading of Cargo Aircraft confined to a “freighter type aircraft” ? Or would the term “cargo aircraft” include a “passenger type aircraft” used only to carry “cargo” with “no revenue nor non-revenue passengers onboard”. Will it be admitted as “cargo aircraft” allowed to accommodate CAO designated shipments? Can a “passenger type aircraft” be used as a “cargo aircraft” in an emergency in carrying lithiu batteires for maintenance purpose (PI 965 and PI 968) . There will be no revenue nor non-revenue passengers on board and it will be operated as a “cargo flight” on the Flight Plan.  (30 Nov 18)

According to Appendix A “Glossary” of the DGR, Cargo Aircraft is defined as “Any aircraft, other than a passenger aircraft, which is carrying goods or property.” Passenger Aircraft is defined as “An aircraft that carries any person other than a crew member, an operator’s employee in an official capacity, an authorized representative of an appropriate national authority or a person accompanying a consignment or other cargo.”

To effectively carry cargo, freighters have all seats removed providing a hollow fuselage. The term “cargo aircraft” is not confined to mean just “freighters” but it also includes passenger type aircraft used to carry cargo only with no passengers, revenue or non-revenue. The Flight Plan is submitted as a “Cargo Flight” under the bilateral agreement. Such “cargo use passenger aircraft” may accommodate CAO shipments per DGR but must also abide to all the conditions for a CAO aircraft spelled out in DGR 9.3.4 including the Class C cargo compartment clause.

Freighters can also be converted into a “passenger aircraft” in an emergency of getting people out from some unusual incident by adding the required number of seats, and filing a Flight Plan for a “passenger flight”.

If operating as a charter flight, you need to watch the charter flight limitations in the bilateral air agreement.
