The name and address of AAA Co, Ltd. was entered in the “Shipper’s Name & Address” box showing the address as c/o BBB Company Ltd. The name of BBB Company Ltd. was entered in the box “Issuing Carrier’s Agent”. A cargo claim arose from this shipment, and the carrier received a claim from BBB Company Ltd. We feel BBB Company is not party to this shipment and do not have the legal right to file a claim. Please give us your guidance. (31 Jul 16)

According to the explanation given, the business relationship between the shipper, AAA Co., Ltd., and the cargo agent, BBB Company Ltd., is not clear. Is it just a relationship of tenant versus landlord, or is it a simple shipper and cargo agent relationship, or a business relationship where BBB undertakes the interests and rights of AAA. It is necessary to inspect the contract document exchanged between AAA and BBB to confirm that BBB possesses the status of representation from AAA on claim matters.
